Notice on Adjusting the Standards of Civil Cases of the First Instance of the Higher People's Court and the Intermediate People's Court

The Higher People's Courts of all provinces, autonomous regions and municipalities directly under the Central Government, the Military Court of the People's Liberation Army, and the Branch of the Production and Construction Corps of the Higher People's Court of Xinjiang Uygur Autonomous Region:

In order to adapt to the development requirements of the trial work in the new era, rationally position the civil trial function of the fourth-level courts and promote the resolution of contradictions and disputes, the center of gravity of the first-instance civil cases under the jurisdiction of the High People ’s Court and the Intermediate People ’s Court is hereby notified as follows:

1. The upper limit of the amount of litigation subject in the first-instance civil cases under the jurisdiction of the Intermediate People ’s Court is in principle 5 billion yuan (RMB). Notice of Case Standards (Fafa [2010] No. 5), “Notice of the Supreme People ’s Court on Adjusting the Standards of Civil and Commercial Cases of the First Trial of the Higher People ’s Courts and Intermediate People ’s Courts” (Fafa [2015] No. 7), “ Notice of the Supreme People ’s Court on Clarifying the Jurisdiction Standards for Foreign Civil and Commercial Cases in the First Instance and Related Issues of Centralized Handling (Law [2017] No. 359) “The Supreme People ’s Court on Adjusting Some Higher People ’s Courts and Intermediate People ’s Courts to Administer the First Instance The Notice on Standards of Commercial Cases (Fafa [2018] No. 13) and other documents are implemented.

2. The High People's Court has jurisdiction over the litigation subject amount of more than 5 billion yuan (RMB) (including the number) or other first-instance civil cases with significant influence in the area under its jurisdiction.

3. The level of jurisdiction for maritime and commercial cases and foreign-related civil cases shall be implemented in accordance with this notice.

4. The level of jurisdiction for civil cases of intellectual property rights shall be implemented in accordance with this notice, except for the types of cases referred to in Article 2 of the Provisions of the Supreme People's Court on Certain Issues Concerning Intellectual Property Courts.

5. The provisions of the Supreme People's Court on the level of jurisdiction for first-instance civil cases previously inconsistent with this notice shall no longer apply.

This notice will be implemented from May 1, 2019. Please report to the hospital in a timely manner any problems encountered during the implementation process.
